The High Court upheld both provisions, holding that input tax credit is a statutory concession subject to conditions and time limits fixed by the legislature. Practical effect: Do not rely on litigation to rescue late credit claims — reconcile and claim within the statutory deadline for each financial year.
Notification No. 10/2018-Central Tax (Rate) dated 23.03.2018 · 2018-03-23
This notification amended Notification 08/2017-Central Tax (Rate) to extend the exemption from reverse charge on intra-State supplies received by a registered person from an unregistered supplier, moving the end date from 31 March 2018 to 30 June 2018. It was the first of several extensions granted while the Government considered how to redesign section 9(4) rather than let it revive in its original sweeping form.

The Chennai company provided management consultancy and detailed project report services to the Chennai Metro Water Supply and Sewerage Board for water related projects. It asked whether the service attracted GST. The Authority held that the supply was a pure service with no supply of goods involved, rendered in relation to a function entrusted to a municipality, and was therefore exempt from GST under the entry covering pure services supplied to government and local authorities.
