The assessment orders had denied input tax credit purely because the returns were filed after the Section 16(4) cut-off. The Court held that the challenge was squarely covered by newly inserted Section 16(5), which permits credit on invoices relating to the financial years 2017-18 to 2020-21 if taken in any return filed up to 30 November 2021, notwithstanding Section 16(4). The impugned orders were quashed and the matter remitted for fresh orders consistent with the amendment.
How we apply it: A Chennai dealer whose ITC for 2017-18 to 2020-21 was disallowed only for late filing should apply for rectification or move the High Court, since Section 16(5) now protects that credit.
Notification No. 09/2021-Central Tax · 2021-05-01
The late fee under Section 47 for GSTR-3B was waived for the March and April 2021 tax periods, later extended to May 2021, for a specified number of days beyond the due date. Taxpayers with turnover above Rs 5 crore received a fifteen-day waiver while smaller taxpayers received thirty days, with a corresponding waiver for quarterly filers of the January to March 2021 quarter. Beyond the waived window the ordinary late fee applied from the original due date.
What it means for you: Returns for March to May 2021 filed within the extended window carry no late fee, and portal-generated demands for those months are frequently overstated.
GSTN Advisory, 2022 — Table 3.1.1 of Form GSTR-3B introduced by Notification No. 14/2022-Central Tax, dated 5 July 2022 · 2022
Table 3.1.1 was added to GSTR-3B so that supplies notified under Section 9(5), such as passenger transport, restaurant service supplied through an app, hotel accommodation and housekeeping, are reported separately. The e-commerce operator reports the value and pays the tax in row (i), while the underlying supplier reports the same value in row (ii) and pays nothing on it, so the turnover is not counted twice across the two returns.
What it means for you: Chennai restaurants and cab operators supplying through an app must still report those sales in Table 3.1.1(ii) even though the platform pays the tax.
