Eicher Motors had deposited tax amounts into its electronic cash ledger before the due dates but filed GSTR-3B belatedly owing to transitional credit issues, and the department demanded interest under Section 50. The Madras High Court held that once the amount is credited to the Government via the electronic cash ledger by the due date, the tax liability stands discharged to that extent, and no interest is leviable merely because the return was filed late. This reasoning has since been followed by other High Courts.

Can my company claim ITC on GST paid to a contractor building our new office?
Generally no. Section 17(5) blocks input tax credit on works contract services and on goods or services used for construction of immovable property on your own account, even when the building is used for business. The exception is plant and machinery, so credit on GST paid for installing machinery, equipment or apparatus fixed to earth remains available.
