The Court examined whether canned or branded software sold on floppies and discs could be taxed as goods under sales tax law. It held that the term goods covers all types of movable property, tangible or intangible, provided the item can be abstracted, transmitted, transferred, delivered, stored and possessed. Branded software satisfies that test and is goods, even though the intellectual content is intangible. Customised software developed for a single customer stands on a different footing.

Circular No. 141/11/2020-GST dated 24 June 2020 · 2020-06-24
This circular explained Notifications 51, 52 and 53 of 2020-Central Tax issued on the recommendations of the 40th GST Council meeting. The rate of interest was reduced from eighteen to nine per cent for specified periods, and for small taxpayers it was staggered, with nil interest up to a specified date and nine per cent thereafter until 30 September 2020. The conditional waiver of late fee on GSTR-3B was given revised dates for February to April 2020 and extended to May, June and July 2020 for small taxpayers, and late fee on delayed GSTR-1 was waived if filed by the specified dates. Circular No. 136/06/2020-GST was modified to this extent.
Practical effect: The late fee waiver here is conditional: if the GSTR-3B was not filed by the notified date, late fee runs from the original due date, so the actual filing date decides whether any waiver survives.
TVH Lumbini Square Owners Association - AAR Tamil Nadu, Order No. 25/ARA/2019, dated 21 June 2019 · 2019-06-21
A residents welfare association collected monthly maintenance contributions from its members. The Authority held that where the contribution per member exceeds Rs. 7,500 a month, GST is payable on the entire contribution and not merely on the amount above Rs. 7,500. The Madras High Court subsequently held, in Greenwood Owners Association, that only the excess over Rs. 7,500 is taxable, and associations now follow that judicial position.
