A printing house printed leaflets and similar material using content supplied by the customer but paper, ink and other physical inputs of its own. It asked for the correct classification and rate. The Authority held that this is a composite supply in which the printing service is the principal supply, and the supply is therefore taxable at 18 percent. The customer supplying only the content or artwork did not alter the classification.

Calcutta High Court: no ITC recovery from buyer for GSTR-2A mismatch without first proceeding against the supplier

Suncraft Energy (P) Ltd v. Assistant Commissioner — Calcutta High Court, 2023 (department's SLP dismissed by Supreme Court) · 2023-08-02

The department reversed a buyer's ITC because certain invoices did not appear in GSTR-2A. The Calcutta High Court held that where the buyer holds a valid tax invoice and proof of payment to the supplier, the authorities must first act against the defaulting supplier; recovery from the recipient is warranted only in exceptional cases such as collusion or a missing supplier. Reliance was placed on CBIC press releases clarifying GSTR-2A is facilitative. The Supreme Court dismissed the department's SLP.

What is the general penalty under Section 125 and when is it imposed?

If the return is not filed within fifteen days, the officer can complete a best judgment assessment under Section 62 and pass an order in Form ASMT-13, estimating your liability from GSTR-1 data, e-way bills and bank information. Such estimates are usually far higher than the actual dues. The assessment is deemed withdrawn if you file the valid return within sixty days of the order, on payment of late fee and interest. My customer in Mumbai asked me to deliver goods directly to his buyer in Mangadu. How do I bill this?
This is a bill-to ship-to transaction under Section 10(1)(b).
