An exporter's IGST refund on exported goods was withheld because it had claimed duty drawback at the higher rate. In Special Civil Application No. 20126 of 2018, the Gujarat High Court held that the shipping bill itself is deemed a refund application under Rule 96, the circular relied on by the department could not override the rules, and the refund of IGST paid on exports cannot be denied on account of the drawback claim. The court directed payment of the withheld refund with interest, setting a widely followed precedent for exporters.

34th GST Council Meeting (video conferencing) — 19 March 2019 · 2019-03-19
The Council gave promoters a one-time option to continue paying tax at the old effective rates of eight or twelve per cent with input tax credit on ongoing projects, meaning buildings where both construction and actual booking had started before 1 April 2019 and which were not completed by 31 March 2019. The option had to be exercised once within a prescribed time frame, failing which the new rates applied automatically. Credit for projects moving across was to be transitioned pro rata.
How we apply it: Chennai builders who did not formally exercise the option in 2019 are on the one and five per cent no-credit rates, and any credit claimed since then is exposed to reversal.
Circular No. 225/19/2024-GST · 2024-07-11
Building on the earlier corporate guarantee circular, the Board clarified that the special valuation rule in Rule 28(2) applies to guarantees issued or renewed on or after 26 October 2023, and that the one per cent value is to be read as one per cent per annum of the guarantee amount, apportioned where the guarantee runs for a shorter period. It also confirmed that where the recipient is eligible for full input tax credit, the value declared in the invoice is deemed to be the open market value.
What it means for you: Chennai promoters and holding companies giving guarantees for group borrowings should compute the value annually and, where the borrower takes full credit, can adopt the invoice value.
