The Karnataka AAR examined which income streams of an individual count towards aggregate turnover for GST registration. It held that salary received as an executive, full-time director is outside the ambit of GST and not includable in aggregate turnover. In contrast, remuneration of a non-executive director is a taxable service, and such amounts, along with partner's salary from a firm, interest income and rental income — including residential rent that is itself exempt — must be counted when testing the registration threshold.
Practical effect: Individuals with mixed income should compute the GST registration threshold carefully, excluding employee salary but including non-executive director fees and rentals.
Paschimanchal Vidyut Vitran Nigam Ltd v. Raman Ispat (P) Ltd — Supreme Court, judgment dated 17-07-2023 · 2023-07-17
The Supreme Court distinguished its earlier Rainbow Papers ruling and held that in liquidation, government and statutory dues fall under Section 53(1)(e) of the Insolvency and Bankruptcy Code, ranking below secured creditors and workmen's dues. Rainbow Papers was confined to its own facts, where a resolution plan had been approved ignoring statutory dues. The waterfall mechanism laid down by Parliament must be respected and cannot be overridden by a general statutory charge.
Practical effect: For a Chennai business in liquidation, GST arrears will be paid only after secured lenders and workmen, which affects how recovery notices against the company should be handled.

Following the 45th GST Council meeting, restaurant service supplied through an e-commerce operator was notified under section 9(5) with effect from 1 January 2022. CBIC clarified that the operator, and not the restaurant, is liable to pay the tax on such supplies, must discharge it in cash without using input tax credit, and issues the invoice for the service. The restaurant continues to pay tax on its own dine-in and direct sales, and the aggregate turnover of the restaurant still includes the supplies made through the platform.
Practical effect: Chennai restaurants listed on delivery platforms must separate platform sales from direct sales in their records, because the tax on the former is paid by the platform.
