Saro Enterprises - AAR Tamil Nadu (2018), upheld by AAAR Tamil Nadu, order dated 6 February 2019 · 2018

The applicant made polypropylene and recycled plastic trays used by farmers to raise paddy and vegetable seedlings, and argued that they were agricultural implements. The Authority held that the trays are other articles of plastic under heading 3926 90 99 and are taxable at 9 percent central tax and 9 percent State tax. Use in agriculture does not by itself bring a product within the exempt agricultural implements entry, and the material and the tariff description prevail over the end use.

Rule 37A: reverse credit if your supplier never files GSTR-3B

Rule 37A, CGST Rules, 2017, inserted by Notification No. 26/2022-Central Tax · 2022-12-26

Rule 37A makes the buyer responsible where a supplier declares an invoice in GSTR-1 but fails to file the corresponding GSTR-3B by 30 September following the end of that financial year. The recipient must reverse the input tax credit availed on that invoice by 30 November of that year, failing which interest under Section 50 runs. If the supplier later files the return and pays tax, the recipient may re-avail the credit without any time limit.

Meeting by video conference barely a fortnight after rollout, the Council found that the combination of a twenty-eight per cent rate and the compensation cess rates originally fixed had left cigarettes bearing less tax than under the earlier excise and VAT regime, handing manufacturers a windfall. The Council recommended an increase in the compensation cess rates on cigarettes so as to align the total GST incidence with the pre-GST level, and the revised cess rates were notified with effect from 18 July 2017.

What is a debit note under GST and when do I issue one?
You issue a debit note when the taxable value or tax charged in the original invoice was less than what is actually payable, for example a price escalation clause kicking in or a rate charged short. Declaring the debit note in GSTR-1 increases your output liability, payable with interest where the shortfall relates to an earlier period. There is no outer time limit on issuing a debit note itself. For your buyer, the debit note is a credit document: following the amendment to Section 16(4), the buyer's time limit to claim ITC runs from the date of the debit note, not the original invoice.
What happens if I miss filing GSTR-3B this month?
A late fee of Rs.50 per day (Rs.20 per day for a nil return) accrues automatically, capped based on your turnover, and interest at 18 percent per annum applies on tax paid late. You also cannot file the next period's GSTR-1 until the pending GSTR-3B is filed, since returns must be filed sequentially. If two consecutive tax periods remain unfiled, e-way bill generation gets blocked, and continued default can lead to suspension of your GSTIN. What is the difference between CPIN and CIN, and how long is a GST challan valid?
When you generate a challan in Form PMT-06 on the portal, the system issues a fourteen-digit Common Portal Identification Number, the CPIN, which identifies the unpaid challan and remains valid for fifteen days. Once the bank receives your payment, a seventeen-digit Challan Identification Number, the CIN, is generated, comprising the CPIN plus the bank code, and the amount credits your electronic cash ledger. If a challan expires unpaid, simply generate a fresh one; no consequence follows. Payment modes include net banking, UPI, cards, NEFT or RTGS, and over-the-counter deposit up to Rs.10,000 per challan per tax period.
Why is the portal not letting me file GSTR-1?
Under Rule 59(6) of the CGST Rules, the portal blocks GSTR-1 filing if the GSTR-3B of the preceding tax period has not been filed. GST returns are sequential, so a single skipped GSTR-3B stops the entire chain. The fix is to file the pending GSTR-3B along with its late fee and interest, after which GSTR-1 opens up again. What is the QRMP scheme and can my business opt for it?
QRMP stands for Quarterly Return filing and Monthly Payment. Taxpayers with aggregate turnover up to Rs.5 crore in the preceding financial year can opt in. What is the GST rate on a works contract for a commercial building?
Under GST, a works contract relating to immovable property is treated wholly as a supply of services, and the standard rate is 18 percent on the contract value, with the contractor eligible for input tax credit on cement, steel and other inputs. This applies to construction, fabrication, erection, repair and renovation contracts for factories, offices and commercial buildings. The old VAT-plus-service-tax splitting of material and labour is gone; one rate applies to the whole consideration. Contractors should also note that free-issue materials supplied by the client can affect valuation, so contract drafting deserves attention before quoting.
Which educational services are actually exempt from GST?
The exemption is confined to an educational institution as defined, meaning one providing pre-school education, education up to higher secondary school or equivalent, education as part of a curriculum for obtaining a qualification recognised by Indian law, or an approved vocational education course. Services by such institutions to their students, and specified input services to schools such as transport, catering and security, are exempt. Everything outside this boundary is taxable: private tuition, test preparation, hobby classes, skill courses without recognised certification, and training by ed-tech companies. The recognition of the qualification under Indian law is the decisive test, not the subject taught.
I buy electronics stock from distributors in other states. How does the IGST on purchases work for me?
Inter-state purchases carry IGST, which flows into your GSTR-2B once the distributor files GSTR-1, and it is fully available as input tax credit. When you sell locally in Tamil Nadu you charge CGST and SGST, and the law lets you use IGST credit against both, with the portal applying the set-off order automatically.
