Co-owners had let a residential building to a company that ran it as a hostel for students and working professionals. The advance ruling authorities denied exemption on the view that the lessee was using the property commercially. The High Court disagreed and held that leasing residential premises used as a hostel falls within Entry 13 of the IGST services exemption notification, since that entry does not require the lessee itself to occupy the premises as a residence. The Supreme Court dismissed the State's appeals on 4 December 2025 and confirmed that the end use as a residence, not the intermediate commercial layer, decides the question.
What it means for you: Chennai property owners letting buildings to hostel operators now have Supreme Court backing for periods before 18 July 2022, though later periods must also account for the registered-tenant reverse charge.

GSTN first advised that from the April 2025 period, auto-populated values in Table 3.2 of GSTR-3B, covering inter-state supplies to unregistered persons, composition taxpayers and UIN holders, would become non-editable, with corrections routed through GSTR-1A. After taxpayer representations, a 16 May 2025 advisory kept Table 3.2 editable for the time being. The locking was later subsumed in the broader hard-locking of GSTR-3B liability during 2025.
Why this matters: Report place-of-supply details correctly in GSTR-1 itself, since state-wise B2C figures in GSTR-3B are moving beyond manual correction.
55th GST Council Meeting, Jaisalmer — 21 December 2024 · 2024-12-21
The 55th meeting reduced GST on fortified rice kernel (FRK) to 5 per cent regardless of end use, supporting public distribution fortification programmes. Gene therapy was fully exempted from GST, a major relief for patients of ultra-expensive treatments. Autoclaved aerated concrete (ACC) blocks containing more than 50 per cent fly ash content were classified under HS 6815 at 12 per cent. The Council also reduced the rate of compensation cess to 0.1 per cent on supplies to merchant exporters, bringing it on par with the concessional 0.1 per cent GST rate on such supplies.
What to do about it: Construction suppliers dealing in fly-ash-based AAC blocks should bill at 12 per cent and revisit classification disputes on past supplies.
