It argued that these were only flours of cereals and pulses taxable at 5 percent. The Authority classified the products under heading 2106 90 as food preparations not elsewhere specified, attracting 18 percent GST, because the mixing and added ingredients took them out of the concessional flour entries. The Appellate Authority upheld that classification.

An exporter's refund of accumulated input tax credit was refused on the ground that its supplier was alleged to have passed on fraudulent credit. The High Court found there was no material to show that the goods had not in fact been received or exported. It held that an allegation against the supplier, unsupported by any finding that the exporter's purchases were not genuine, cannot justify withholding refund, and directed the refund to be processed.

Circular No. 176/08/2022-GST · 2022-07-06
The Board withdrew Circular No. 106/25/2019-GST dated 29 June 2019, which had prescribed a special refund mechanism for retail outlets in the departure area of international airports supplying indigenous goods to outgoing international passengers. The special procedure on which that mechanism rested was discontinued, so the separate refund route no longer operates. Such outlets must now follow the ordinary refund provisions instead of the withdrawn special procedure.
