Circular No. 177/09/2022-TRU · 2022-08-03
The Board answered a set of service classification and exemption questions arising from the 47th GST Council meeting. Most importantly for property transactions, it confirmed that the sale of land after levelling and after laying drainage, water and electricity lines remains a sale of land under Schedule III and is outside GST, while development services such as levelling and laying of drainage lines that the developer itself receives from contractors attract GST at the applicable rate. Several other exemption and rate questions on specified services were also settled.
Why this matters: Chennai plot developers can rely on this circular for the position that a plot sale price is not taxable, but must still bear GST on the development works they buy in from contractors.
GSTN Advisory dated 7 June 2025 — non-editable auto-populated liability in GSTR-3B · 2025-06-07
After an October 2024 advisory and a January 2025 deferment, GSTN confirmed that from the July 2025 tax period the auto-populated outward tax liability in GSTR-3B, drawn from GSTR-1, IFF or GSTR-1A, is hard-locked and cannot be edited manually while filing. Any correction to sales figures must be made through GSTR-1A before GSTR-3B is filed. The change is intended to end mismatches between GSTR-1 and GSTR-3B.
What to do about it: Reconcile sales data before filing GSTR-1 each month, since GSTR-3B can no longer be adjusted at the last minute.
Notification No. 13/2017-Central Tax (Rate) dated 28.06.2017 · 2017-06-28
This notification specifies the categories of services under section 9(3) on which the whole of the tax is payable by the recipient rather than the supplier. The original list covers goods transport agency services, legal services by an individual advocate or firm of advocates, arbitral tribunal services, sponsorship, most services supplied by the Central or State Government or a local authority, services of a director to a company, insurance agent services, recovery agent services and certain transport and copyright services.
