Many taxpayers paid tax through Form DRC-03 in response to a notice, yet the demand continued to show as outstanding in the electronic liability register because the payment was never linked to the order. The new rule introduced Form GST DRC-03A, through which such a payment can be mapped to the corresponding demand order so that the liability register is updated and recovery, interest and penalty computations stop. The facility went live on the portal from November 2024.

Practical effect: If you paid a demand through DRC-03 but the portal still shows arrears, file DRC-03A to close the entry before recovery or bank attachment proceedings begin.

The club collected membership subscriptions and admission fees which were spent on meetings, administration and communication, with no facility or benefit supplied to members in return. The Maharashtra Appellate Authority for Advance Ruling held that the collections merely defray shared expenses, that there is no supply of goods or services to members, and that the amounts are therefore not consideration liable to tax.

I received a DRC-01 notice for ITC mismatch between GSTR-3B and GSTR-2A. How do I defend it?
Start with a supplier-wise reconciliation identifying why each credit is missing from GSTR-2A, such as the supplier filing late, quoting a wrong GSTIN or reporting B2B supplies as B2C. For FY 2017-18 and 2018-19, CBIC Circular 183/15/2022 permits proving genuine credits through supplier certificates or CA certificates, which resolves many Meenambakkam cases. What happens after I file Form APL-01 on the GST portal?
The portal issues a provisional acknowledgment immediately, and the appeal is formally admitted when the final acknowledgment in APL-02 is issued after document verification. The appellate authority then fixes personal hearings, where your authorised representative argues the grounds and files written submissions and case law. Up to three adjournments may be granted per side. The authority must pass a speaking order, which it should endeavour to issue within one year of filing, and the outcome is communicated in a summary along with the order. The authority can confirm, modify or annul the order but cannot send the case back to the original officer.
What is the general penalty under Section 125 and when is it imposed?
Section 125 is the residual penalty provision for contraventions of the Act or rules for which no separate penalty is prescribed anywhere else. It can extend to Rs.25,000 under the CGST Act, with a matching penalty under the SGST Act, so the practical exposure is up to Rs.50,000 per contravention. Officers invoke it for procedural lapses such as not displaying the registration certificate, minor documentation errors during transit, or failure to furnish information called for. Because the amount is discretionary, a reasoned reply showing the breach was technical and without revenue loss often brings the figure down substantially.
The GST department has issued me a summons under Section 70. Is it serious?
Yes, a summons should never be ignored. Under Section 70 the officer has the powers of a civil court, and the inquiry is a judicial proceeding. You must appear on the given date and time with the documents listed, and your statement will be recorded. Non-appearance can invite penalty and, in extreme cases, prosecution. Before attending, reconstruct the facts, reconcile your returns and carry organised records of the transactions under inquiry. My customer in Mumbai asked me to deliver goods directly to his buyer in Meenambakkam. How do I bill this?
This is a bill-to ship-to transaction under Section 10(1)(b). When goods are delivered to a third party on the instruction of your customer, the law deems your customer's principal place of business as the place of supply, not the actual delivery point. Yes. Rule 18 of the CGST Rules requires every registered person to display the registration certificate in a prominent location at the principal place of business and every additional place, and to display the GSTIN on the name board at the entry of each such premises. There is no separate penalty provision for this lapse, so officers invoke the general penalty under Section 125, which can extend to Rs.25,000 under CGST with a matching state penalty.
