The manufacturer supplied electrical wiring harness, essentially electrical wire with connectors at both ends, used in motor vehicles, and asked whether it should be classified as a motor vehicle part or as insulated electrical conductors. The Authority classified the product under heading 8544, which covers insulated wire and cable fitted with connectors, taxable at 9 percent central tax and 9 percent State tax following Notification No. 41/2017-Central Tax (Rate) dated 14 November 2017, the earlier rate having been higher.

Circular No. 49/23/2018-GST dated 21 June 2018 · 2018-06-21
This circular modified the detention procedure. The expression three working days in the earlier circular was replaced by three days, and the release wording in FORM GST MOV-05 was corrected. Most importantly it reiterated rule 138C(2): once physical verification of goods in transit has been carried out at one place, no further physical verification of the same conveyance may be done anywhere in India unless specific information relating to tax evasion is made available subsequently.
What to do about it: A truck already verified once should not be stopped and unloaded again on the same journey, and the earlier verification report is your defence.

Goods were detained because the squad officer disagreed with the HSN classification and rate adopted by the consignor. The Madras High Court quashed the detention, holding that a squad officer may intercept goods and prepare the record but cannot finally decide questions of classification or rate, which belong to the jurisdictional assessing officer. The Court directed the Commissioner of Commercial Taxes to instruct squad officers not to detain goods where there is a bona fide dispute about exigibility or rate of tax.
