The dual-control deadlock that had stalled several earlier meetings was broken. The Council agreed that taxpayers would be divided between Central and State tax administrations for all administrative purposes: of taxpayers with turnover below Rs 1.5 crore, 90 per cent would go to the State administration and 10 per cent to the Centre, while taxpayers above Rs 1.5 crore would be split equally. Division was to be by computerised stratified random sampling at the State level, with both administrations retaining intelligence-based enforcement powers over the whole value chain. West Bengal recorded its dissent.
Why this matters: This is why a Chennai taxpayer is assigned either to the Tamil Nadu Commercial Taxes Department or to CGST Chennai, and why notices come from only one of them for routine matters.

Deciding a service tax dispute whose reasoning applies equally under GST, the Supreme Court held that when an overseas group company seconds its employees to an Indian entity, and the Indian entity reimburses their salaries to the foreign company, the arrangement is a taxable supply of manpower services by the foreign company. Applying a substance-over-form test on the totality of the secondment agreements, the Court ruled the Indian company must pay tax under reverse charge on such arrangements.
What to do about it: Chennai companies with expatriate secondees from foreign group entities should review their reverse-charge GST exposure on salary reimbursements and structure secondment agreements carefully.

The maximum pre-deposit for a first appeal under Section 107 was reduced from Rs 25 crore to Rs 20 crore each of CGST and SGST, the rate remaining ten per cent of the disputed tax. For appeals to the GST Appellate Tribunal, the pre-deposit was reduced from twenty per cent to ten per cent of the disputed tax, subject to a ceiling of Rs 20 crore each of CGST and SGST, in addition to the amount already deposited at the first appellate stage.
What it means for you: A second appeal to the Tribunal now costs ten per cent rather than twenty per cent of the disputed tax, making it far more affordable to carry a bad order forward.
