Section 9(4) of the CGST Act as originally enacted made a registered person liable to pay tax under reverse charge on all inward supplies received from unregistered persons. This notification granted a de minimis exemption where the aggregate value of such supplies received from all unregistered suppliers did not exceed Rs 5,000 in a day. The exemption proved unworkable in practice and section 9(4) was soon suspended altogether.
Why this matters: This threshold only matters for the July to October 2017 period, and Chennai businesses still facing scrutiny for those months should check the daily aggregate rather than invoice-wise values.

The taxpayer argued that once the State GST authorities had taken up his case, Section 6(2)(b) barred the Central intelligence wing from issuing summons on the same subject. The Division Bench drew a distinction between a 'proceeding' such as assessment, adjudication or recovery, and an 'inquiry' under Section 70. The bar in Section 6(2)(b) applies only to overlapping proceedings on the same subject matter, and does not prevent an intelligence-based inquiry by the other authority. The summons was upheld.
Practical effect: A Chennai business already under State GST scrutiny cannot refuse a DGGI summons on cross-empowerment grounds, though it can still object if the Centre later starts a parallel adjudication on the identical issue and period.

CBIC clarified that where a manufacturer replaces parts or provides repair services free of cost during the warranty period, no further GST is payable because the value of the warranty was already included in the price of the original supply on which tax was paid. Consequently the manufacturer need not reverse input tax credit on such replacement parts. Where a distributor replaces parts from his own stock and is reimbursed through a credit note, the position was explained separately.
Practical effect: Manufacturers and dealers should not pay GST again on warranty replacements, and should resist ITC reversal demands raised on free-of-cost warranty issues.
