The taxpayer argued that Rule 86A permits blocking only of credit actually available in the ledger, so a negative block was without jurisdiction. Departing from the Gujarat and Delhi High Court view, the Madras High Court adopted a purposive reading and held that 'available' means credit that was available at any point of time for debit, so negative blocking is permissible. It also held that Central and State authorities may act independently for different periods and amounts. The petition was dismissed.

I got a show cause notice in REG-17 threatening cancellation of my GST registration. What should I do?
Form REG-17 is issued when the officer proposes to cancel your registration, commonly for continuous non-filing of returns, non-existence at the declared premises or wrongful ITC availment. You must reply in Form REG-18 within seven working days and attend the hearing if one is fixed. If the reply satisfies the officer, proceedings are dropped in REG-20; otherwise cancellation is ordered in REG-19. If cancellation happens, you can seek revocation in Form REG-21 within ninety days after filing all pending returns and paying dues. Because cancelled registrations freeze e-way bills and invoicing, treat a REG-17 in Mylapore as urgent.
At what amount of tax evasion can GST prosecution be launched?

Notices issued through the GST portal carry a Reference Number that can be checked after logging in, and a genuine notice will also appear in your View Notices and Orders or View Additional Notices and Orders tab. As per CBIC instructions, a communication without a DIN is treated as invalid. Be cautious of demands received only on WhatsApp or email asking for payment to personal accounts. My GST registration was rejected in REG-05 after a clarification notice. Can I apply again?
Yes. A rejection order in Form REG-05 does not bar you from applying afresh. You can file a new registration application after curing the defects the officer pointed out, such as an incomplete rental agreement, mismatched address proof or missing authorisation letter. Alternatively, if you believe the rejection was wrong, you can challenge the order by filing an appeal in Form APL-01 within three months. What is the difference between GST return scrutiny and a departmental audit?

What are the rules for numbering GST invoices?
The invoice serial number must be consecutive, must not exceed sixteen characters, and may contain alphabets, numerals and the special characters hyphen and slash, in one or multiple series. Gaps in a series invite questions during audit because officers may suspect unreported invoices, and cancelled invoice numbers should be retained in records with the cancelled copy. Does compensation cess still apply on any goods?
For most goods, no. With the rate restructuring of 22 September 2025, compensation cess was discontinued on items such as cars, and the demerit burden was merged into the single 40 percent rate. The cess continues only on pan masala and specified tobacco products during the transition period while past compensation cess loan obligations are being discharged. A practical point for traders: balances of unutilised compensation cess credit cannot be cross-utilised against CGST, SGST or IGST liability, so businesses holding old cess credit should evaluate their position rather than assuming it will set off future tax.
Is GST still charged on life and health insurance premiums?
No. With effect from 22 September 2025, premiums on all individual life insurance policies, including term plans, endowment plans and ULIPs, and all individual health insurance policies, including family floater and senior citizen plans, are exempt from GST. Reinsurance of these policies is also exempt. Earlier these premiums bore 18 percent tax. Note that the exemption applies to policies taken by individuals; certain group covers procured by businesses can still attract GST, and insurers can no longer claim input credit attributable to exempt policies. Policyholders should see the benefit directly in renewal notices.
By when must I issue a tax invoice when I sell goods?
For goods, Section 31 requires the tax invoice to be issued before or at the time of removal of the goods, where the supply involves movement, or before or at the time of delivery or making the goods available in other cases.
