Most importantly for property transactions, it confirmed that the sale of land after levelling and after laying drainage, water and electricity lines remains a sale of land under Schedule III and is outside GST, while development services such as levelling and laying of drainage lines that the developer itself receives from contractors attract GST at the applicable rate. Several other exemption and rate questions on specified services were also settled.
Practical effect: Chennai plot developers can rely on this circular for the position that a plot sale price is not taxable, but must still bear GST on the development works they buy in from contractors.

The applicant promoted the products of overseas manufacturers in India and also carried out installation, commissioning and after-sales support for Indian customers, billing the foreign principal in convertible foreign exchange. The Karnataka Authority for Advance Ruling held that this activity facilitates the supply between the foreign principal and the Indian customer, making the applicant an intermediary. The place of supply is therefore in India and the receipts do not qualify as export of service.
