Circular No. 178/10/2022-GST · 2022-08-03
This is the leading circular on the agreeing to tolerate an act entry. The Board held that liquidated damages paid for breach of contract are a flow of money compensating for injury, not consideration for any service, so no GST applies. The same reasoning covers notice pay recovered from employees, cheque dishonour charges, fines and penalties for violation of a contract or a law, and forfeiture of salary or bond amounts, unless there is a genuine independent agreement to tolerate an act. A late payment surcharge or fee is treated differently, as it is naturally bundled with the principal supply and forms part of its value.
What it means for you: Chennai employers and contractors should resist departmental demands on notice pay recovery and liquidated damages by citing this circular in the reply itself.
Mr. Kannippan Arumugan v. Assistant Commissioner (ST) — Madras High Court, W.P. No. 2943 of 2026, decided 30 January 2026 (C. Saravanan J.) · 2026-01-30
The taxpayer had reported tax of Rs 2,54,040.30 against an invoice instead of the correct Rs 1,31,280.30, and a demand followed. The Court quashed the assessment order dated 21 July 2025 and remitted the matter for fresh adjudication within six months, permitting the petitioner to rectify the inadvertent error subject to compliance with Circular No. 212/6/2024-GST, and directing the officer to verify with the recipient's jurisdiction whether excess credit had in fact been availed.
Why this matters: A clerical overstatement in GSTR-1 by a Chennai supplier can still be corrected long afterwards, provided the recipient has not taken the excess credit and the Circular 212 procedure is followed.
Notification No. 8/2021-Central Tax (Rate), dated 30 September 2021 · 2021-09-30
Acting on the 45th GST Council recommendation, the Government raised the rate on solar power based devices, solar generators, photovoltaic cells and modules, wind operated electricity generators, biogas plants and waste-to-energy devices from five per cent to twelve per cent with effect from 1 October 2021. Combined with the 70:30 deeming rule, this pushed up the delivered cost of rooftop and utility scale solar projects and prompted a wave of contract repricing and change-of-rate disputes under Section 14.
What it means for you: Projects straddling 1 October 2021 must fix the rate using the time-of-supply rules in Section 14, since invoice date, payment date and supply date can point to different rates.
