The Telangana AAR had held that liquidated damages recoverable by Achampet Solar from its contractor for delay in commissioning its solar plant were a taxable supply attracting 18 per cent GST. The Appellate Authority set that ruling aside on 19 October 2022, holding that such damages are compensation for breach of contract and not consideration for tolerating an act, so they do not qualify as a supply. The decision aligns with CBIC Circular No. 178/10/2022-GST dated 3 August 2022 on contractual damages.
What to do about it: Do not automatically charge GST on liquidated damages or penalty recoveries; test each clause against the 2022 circular before paying tax.

Acting on a Group of Ministers report, the Council cut rates on COVID relief goods until 30 September 2021. Tocilizumab and Amphotericin B moved to nil, while Remdesivir and anti-coagulants such as heparin were reduced to 5 per cent. Medical grade oxygen, oxygen concentrators, ventilators, BiPAP machines, COVID testing kits and specified diagnostic kits all moved from 12 to 5 per cent. Pulse oximeters, hand sanitiser, temperature check equipment and crematorium furnaces moved to 5 per cent, and ambulances from 28 to 12 per cent.

Following the Finance Act, 2023 amendment to the Compensation Cess Act, the cess on pan masala, gutkha, chewing tobacco, zarda and similar products stopped being charged as a percentage of transaction value and became a specific levy computed on the declared retail sale price per unit, with effect from 1 April 2023. Pan masala, for example, moved from an ad valorem rate to a rate expressed as a proportion of retail sale price, a change designed to defeat undervaluation in the tobacco trade.
What it means for you: Tobacco and pan masala dealers must print and track retail sale price per pack, since the cess is now computed on that figure rather than the invoice value.
