It argued that these were only flours of cereals and pulses taxable at 5 percent. The Authority classified the products under heading 2106 90 as food preparations not elsewhere specified, attracting 18 percent GST, because the mixing and added ingredients took them out of the concessional flour entries. The Appellate Authority upheld that classification.

Circular No. 32/06/2018-GST dated 12.02.2018 · 2018-02-12

This early circular resolved several healthcare and accommodation questions. It clarified that room rent charged by a hospital to an in-patient and food supplied to admitted patients as advised by the doctor form part of exempt composite healthcare services, while food sold to attendants and visitors is taxable. It also clarified that where a hospital engages senior consultants and retains a share of their fees, the entire consideration charged to the patient is exempt healthcare service. Separately it dealt with hostel accommodation below the then exemption threshold.

The Council approved a scheme to incentivise digital payment under GST. Concessions were to be given on B2C transactions paid through RuPay debit card, UPI, BHIM, USSD or BHIM-Aadhaar, by way of an automated refund to the consumer's account of twenty per cent of the total GST paid, subject to a ceiling of Rs 100 per transaction shared equally between CGST and SGST. The purchaser would be informed by SMS. The scheme was to run on a pilot basis in Assam, Tamil Nadu and any other volunteering State.

Why this matters: Tamil Nadu was one of only two States selected for this pilot, though the scheme was never rolled out in practice.

How exactly do I pay RCM in my return and claim it back as credit?
Report the taxable value and tax in Table 3.1(d) of GSTR-3B; this liability must be discharged in cash through the electronic cash ledger, because input tax credit cannot be used to pay reverse charge dues. In the same return, claim the amount as ITC in Table 4(A)(2) or 4(A)(3), so the net impact is usually nil. You must still report these supplies: show them in GSTR-3B Table 3.1.1(ii) as supplies on which the operator pays tax, and disclose them in GSTR-1, without paying tax on them again. What is the late fee if I file a nil return late?
For a nil GSTR-3B or nil GSTR-1 filed after the due date, the late fee is Rs.20 per day of delay (Rs.10 CGST plus Rs.10 SGST), capped at Rs.500 per return (Rs.250 plus Rs.250). No interest applies since there is no tax payable. While Rs.500 sounds small, defaults across several months add up, and the bigger cost is the compliance chain breaking and your GSTIN being flagged. Under QRMP: optional IFF by the 13th of the next month, PMT-06 payment by the 25th, quarterly GSTR-1 by the 13th and GSTR-3B by the 22nd (Tamil Nadu) after the quarter.
