Implementing 55th GST Council decisions, CBIC clarified that penal charges levied by banks and NBFCs for breach of loan terms, which replaced penal interest per RBI directions, are not consideration for any service and attract no GST. It also clarified that RBI-regulated payment aggregators are covered by the exemption for settlement of transactions up to Rs 2,000, and addressed other service-tax positions, regularising past periods on an as-is basis.
Practical effect: Borrowers should not accept GST charged on penal charges by lenders, and merchants using payment aggregators get relief on small-ticket settlement charges.

Refund claims for unutilised credit on zero-rated exports of July to September 2017 were filed on 21 September, 9 October and 10 October 2018, returned through deficiency memos, and resubmitted later. The appellate authority treated the resubmissions as fresh applications and rejected them as time-barred. The Court allowed three of the five petitions and quashed those orders, holding that the original applications were within two years of the exports and that a resubmission after curing deficiencies cannot start a new limitation period, the 2021 proviso to Rule 90(3) not applying retrospectively.
Practical effect: Chennai exporters whose refund was returned by a deficiency memo should preserve the original ARN and acknowledgement — limitation is counted from that first filing, not the re-filed one.

The applicant promoted courses of foreign universities in India and recruited students for them, receiving commission in foreign exchange. It claimed the service was an export and therefore zero rated. The West Bengal Authority for Advance Ruling, affirmed on appeal, held that the applicant merely facilitates admission of students to the university and is an intermediary under Section 2(13) of the IGST Act. As the place of supply of an intermediary is the location of the supplier, the service is a domestic supply liable to GST.
Practical effect: Businesses earning foreign commission for facilitating a third party's supply should test the intermediary risk before treating receipts as zero-rated exports.
