CBIC v. Aberdare Technologies (P) Ltd — Supreme Court, 2025 (SLP against Bombay HC order dated 29-07-2024 dismissed) · 2025-03-21
The Bombay High Court permitted Aberdare Technologies to correct bona fide clerical errors in its GST returns beyond the statutory deadline where there was no loss of revenue. Dismissing the department's SLP, the Supreme Court observed that human errors are normal, denying correction unjustifiably burdens taxpayers and benefits the department at their cost, and asked CBIC to re-examine the rigid timelines for rectifying returns since software limitations cannot defeat substantive rights.
What it means for you: If a genuine clerical mistake in GSTR-1 or GSTR-3B is blocking your customer's ITC or inflating your liability, courts now support rectification even beyond the deadline where revenue is not prejudiced.
Notification No. 32/2020-Central Tax · 2020-04-03
The late fee payable under Section 47 for GSTR-3B was waived entirely for the tax periods February, March and April 2020, subject to the return being furnished within the extended dates set out for each turnover slab. Large taxpayers had to file by 24 June 2020, while smaller taxpayers had staggered dates running into June and July 2020. If the return was filed after the specified date the waiver fell away and the ordinary late fee revived from the original due date.
How we apply it: Check the actual filing date before paying any late fee demand for February to April 2020, because a timely filed return under this notification carries no fee at all.
Nithiyashree Ladies Hostel - AAR Tamil Nadu, Advance Ruling No. 77/AAR/2023, dated 4 September 2023 · 2023-09-04
The applicant ran a ladies hostel in premises it had itself taken on rent and supplied accommodation together with food and related services. It sought exemption on the footing that this was renting of residential accommodation. The Authority held the supply classifiable under heading 9963 and taxable at 9 percent central tax and 9 percent State tax, treating hostel accommodation with attached services as a taxable service and not as renting of a residential dwelling for use as a residence.
