As COVID relief, the Council reduced late fee for all pending GSTR-3B returns for the tax periods from July 2017 to January 2020. Where there was no tax liability the late fee was reduced to nil, and where there was a tax liability it was capped at Rs 500 per return. The reduced or waived late fee applied only if the returns were furnished between 1 July 2020 and 30 September 2020. Certain clauses of the Finance Act, 2020 were brought into force.
What to do about it: This was the single largest late fee amnesty of the early GST years, and businesses that used it cleared years of backlog for a few hundred rupees per return.

Schedule I places butter, ghee and other dairy fats, cheese, condensed and concentrated milk, yoghurt, pre-packaged and labelled curd, lassi and buttermilk, natural honey, roasted coffee, pasta and seviyan, namkeens, bhujia and mixture, ice cream and other edible ice, biscuits, sauces and most processed foods at five per cent. Chena and paneer, ultra-high temperature milk and Indian breads are fully exempt under the companion exemption notification, so the food chain now runs at either nil or five per cent.
What to do about it: Supermarkets and food distributors in Chennai should be charging five per cent or nil on almost their entire grocery range from 22 September 2025.

Resident welfare associations challenged the CBIC circular and AAR view that once monthly maintenance exceeds Rs 7,500 per member, GST applies on the entire amount. The Madras High Court held that the exemption operates up to Rs 7,500, and only the amount in excess of that threshold is taxable — the term 'up to' marks a clear slab. The circular's contrary interpretation was quashed as contrary to the exemption notification.
What to do about it: Chennai apartment associations collecting over Rs 7,500 per month per flat should charge GST only on the excess over Rs 7,500, relying on this jurisdictional ruling.
