Implementing the 47th GST Council recommendations, CBIC clarified that an electrically operated vehicle attracts the concessional five per cent rate whether or not it is fitted with a battery pack at the time of supply, ending a dispute that had hurt manufacturers using battery-swapping models. The circular also addressed the classification of fly ash bricks and blocks, by-products of milling of pulses and dal such as chilka and khanda, treated sewage water, and nicotine polacrilex gum.

Practical effect: Electric vehicle sellers should not be forced into eighteen per cent merely because the battery is billed or leased separately, and this circular is the answer to such a notice.

Munjaal Manishbhai Bhatt v. Union of India — Gujarat High Court, 2022 · 2022-05-06

In a bungalow purchase where land constituted the dominant value, the Gujarat High Court held that the deeming fiction treating land value as one-third of the total consideration for GST on construction is arbitrary if applied mandatorily. Where the actual value of land is ascertainable from the agreement, tax must be computed after deducting the real land value; the one-third deduction in the rate notification was read down as optional, available at the taxpayer's choice.

Practical effect: Builders and buyers with separately valued land agreements can compute GST on actual construction value — worth revisiting for plotted developments and villa projects around Chennai.

Reverse charge on purchases from unregistered persons suspended

Notification No. 38/2017-Central Tax (Rate) dated 13.10.2017 · 2017-10-13

Responding to widespread compliance difficulty, this notification amended Notification 08/2017-Central Tax (Rate) to remove the daily Rs 5,000 limit and exempt all intra-State supplies of goods or services received by a registered person from an unregistered supplier from tax under section 9(4), up to 31 March 2018. In effect it suspended the unregistered-purchase reverse charge entirely rather than merely raising the threshold.

Practical effect: Chennai businesses have not had to pay reverse charge on ordinary purchases from unregistered vendors since 13 October 2017, and the suspension was repeatedly extended before becoming permanent.

Section 34 permits a credit note where the taxable value or tax charged in the invoice exceeds what is actually payable, where the goods are returned by the recipient, or where the goods or services are found deficient. The credit note references the original invoice, and reporting it in your GSTR-1 reduces your output tax liability for that period. It is the correct tool for sales returns, rate errors and quality claims. What a credit note cannot do is cancel an e-invoice after the twenty-four hour IRP window or rewrite history for a different customer; it must trace to a genuine adjustment on an identified invoice.
My bank account was debited for a GST challan but the cash ledger shows nothing. What do I do?
This is a payment-communication failure between the bank and the portal, and the prescribed remedy is Form PMT-07, filed under Services, then Payments, then Grievance against Payment. Quote the CPIN, bank name and debit details; the system takes up the discrepancy with the bank, and the amount either credits your ledger once the bank confirms, or is re-credited to your account if the transaction failed. Where is the place of supply for services connected to a building or land?
Services directly relating to immovable property, including those of architects, interior decorators, engineers, surveyors, construction and works contract services, renting, and accommodation in hotels, are supplied where the property is located, under Section 12(3). The recipient's location and registration are irrelevant. What documents must I prepare for reverse charge purchases from unregistered suppliers?
Two documents are required. First, a self-invoice: Section 31(3)(f) obliges you to issue an invoice on yourself for goods or services received from an unregistered supplier on which you pay tax under reverse charge, and under Rule 47A this self-invoice must be issued within thirty days of receiving the supply.
