Notification No. 52/2020-Central Tax · 2020-06-24

For the tax periods July 2017 to January 2020 the late fee on GSTR-3B was capped at Rs 500 per return, being Rs 250 each under the central and State laws, and was waived completely where the return was a nil return. The concession applied only if the pending return was furnished between 1 July 2020 and 30 September 2020. Meeting by video conference barely a fortnight after rollout, the Council found that the combination of a twenty-eight per cent rate and the compensation cess rates originally fixed had left cigarettes bearing less tax than under the earlier excise and VAT regime, handing manufacturers a windfall. The Council recommended an increase in the compensation cess rates on cigarettes so as to align the total GST incidence with the pre-GST level, and the revised cess rates were notified with effect from 18 July 2017.

Practical effect: It showed early on that the Council would move within days to correct a rate that produced an unintended windfall, in either direction.

CBIC settled a much-litigated question. Remuneration paid to an independent director or any director who is not an employee of the company is taxable in the hands of the company under reverse charge. For a whole-time or executive director, the part declared as salary and on which tax is deducted under section 192 of the Income-tax Act is treated as consideration in the course of employment and is outside GST, while the part treated as professional fees with deduction under section 194J is taxable under reverse charge.

Is there a deadline for declaring credit notes for a financial year?
Yes, and it is strict. A credit note relating to an invoice of a financial year must be declared in your returns by 30 November following the end of that financial year, or the date of filing the annual return, whichever is earlier. After this date, you can no longer reduce your output tax through a GST credit note for that year's invoices; any adjustment becomes purely commercial with no tax benefit. Can one invoice contain items taxed at different GST rates?
Yes, there is no requirement to issue separate invoices per rate.
