Notification No. 47/2019-Central Tax made the annual return optional for registered persons with aggregate turnover below Rs 2 crore for the financial years 2017-18 and 2018-19. CBIC clarified that such a taxpayer who does not file FORM GSTR-9 by the due date will be deemed to have furnished it, and that a return filed after the due date will not be treated as deemed furnished. The Authority, following Circular No. 3/1/2018-IGST dated 25 May 2018, held that the applicant is not liable to pay IGST at the time of removal, the levy arising once at clearance for home consumption.

The department has provisionally attached my bank account under Section 83. What does that mean?
Section 83 empowers the Commissioner, where he records an opinion that protecting revenue requires it, to provisionally attach property including bank accounts during the pendency of specified proceedings, such as assessment, inspection or demand cases. What is the difference between a Section 73 and a Section 74 notice?
Section 73 covers short payment of tax or wrong ITC without fraud, while Section 74 applies where the department alleges fraud, wilful misstatement or suppression of facts to evade tax. Under Section 73 the order must be passed within three years from the annual return due date and the penalty is 10 percent of the tax or Rs.10,000, whichever is higher, with no penalty if you pay before the notice. I declare income under Section 44ADA. Does that mean I am exempt from GST?
No, this is a common myth. Section 44ADA is a presumptive taxation scheme under the Income Tax Act that lets professionals declare fifty percent of gross receipts as income; it has nothing to do with GST. GST liability depends solely on aggregate turnover crossing the registration threshold and the nature of your supplies. In fact, the two departments now cross-match data, so gross receipts reported in your ITR and Form 26AS that exceed the GST turnover you declared are a known trigger for notices. Treat the two laws as parallel obligations, each with its own limits and filings.
What is the penalty for running a business without GST registration?

How do I document free samples and gifts given to customers?
Goods supplied genuinely free of cost to unrelated persons are not a supply, so no tax invoice is raised and no GST is charged; the movement is covered by a delivery challan marked as free samples. The cost is that input tax credit on those goods must be reversed. Two traps deserve care: gifts to related persons or between distinct GSTINs of the same PAN are taxable under Schedule I even without consideration, and promotional schemes like buy one get one are treated as a single price for two items, taxed normally with credit intact.
