The dual-control deadlock that had stalled several earlier meetings was broken. The Council agreed that taxpayers would be divided between Central and State tax administrations for all administrative purposes: of taxpayers with turnover below Rs 1.5 crore, 90 per cent would go to the State administration and 10 per cent to the Centre, while taxpayers above Rs 1.5 crore would be split equally. Division was to be by computerised stratified random sampling at the State level, with both administrations retaining intelligence-based enforcement powers over the whole value chain. West Bengal recorded its dissent.

Sale of developed plots: Gujarat AAR taxed it, CBIC later clarified otherwise

Shree Dipesh Anilkumar Naik — AAR Gujarat, Advance Ruling No. GUJ/GAAR/R/2020/11, dated 19 May 2020; position subsequently clarified by CBIC Circular No. 177/09/2022-TRU, dated 3 August 2022 · 2020-05-19

A landowner obtained approval to develop agricultural land into residential plots and proposed to sell the plots after laying roads, drainage, water lines and other common facilities required by the plan sanction. The Gujarat Authority for Advance Ruling held that the sale price includes the value of development works, so the transaction is a taxable supply of construction service and not a bare sale of land. CBIC later clarified that sale of land after levelling, laying drainage lines and similar works is still sale of land under Schedule III and outside GST.

Practical effect: Plot developers should read the 2022 CBIC clarification alongside older adverse rulings before conceding GST on plot sales or on development charges.

Rule 96(10) omitted: exporters using advance authorisation can again claim IGST refunds

Rules 96(10), 89(4A) and 89(4B), CGST Rules, 2017, omitted by Notification No. 20/2024-Central Tax · 2024-10-08

Rule 96(10) had barred exporters who imported inputs without paying IGST, typically under Advance Authorisation or EPCG, from exporting on payment of IGST and claiming refund of that tax. Rules 89(4A) and 89(4B) prescribed a restrictive formula for their credit refunds. All three were omitted with prospective effect from 8 October 2024, removing a provision that had generated a large volume of recovery notices against exporters.

Why this matters: Exporters may follow the with-payment refund route for shipments made from 8 October 2024, though demands for earlier periods survive and still need to be defended.

The department has provisionally attached my bank account under Section 83. What does that mean?
Section 83 empowers the Commissioner, where he records an opinion that protecting revenue requires it, to provisionally attach property including bank accounts during the pendency of specified proceedings, such as assessment, inspection or demand cases. The attachment order is issued in Form DRC-22 and a copy goes to your bank, which freezes debits. Crucially, the attachment automatically ceases to have effect after one year from the order, and it can be lifted earlier through Form DRC-23 if the Commissioner is satisfied. Courts insist the power is draconian and must be exercised with genuine, recorded reasons, which is a strong ground of challenge in suitable cases.
The GST department has issued me a summons under Section 70. Is it serious?
Yes, a summons should never be ignored. Under Section 70 the officer has the powers of a civil court, and the inquiry is a judicial proceeding. You must appear on the given date and time with the documents listed, and your statement will be recorded. Non-appearance can invite penalty and, in extreme cases, prosecution. Before attending, reconstruct the facts, reconcile your returns and carry organised records of the transactions under inquiry. What imprisonment terms does GST law prescribe, and which offences are non-bailable?
Section 132 links punishment to the amount involved: imprisonment up to five years with fine where the tax evaded or credit misused exceeds Rs.5 crore, up to three years where it exceeds Rs.2 crore, and up to one year for the Rs.1 crore to Rs.2 crore band, which after the Finance Act 2023 changes survives only for the offence of issuing invoices without supply. A repeat conviction can attract up to five years regardless of amount. Offences involving supply without invoice, invoices without supply, credit from such invoices, and collected-but-not-deposited tax are cognizable and non-bailable when the amount exceeds Rs.5 crore; everything else is non-cognizable and bailable. Courts take cognizance only with the Commissioner's previous sanction.
Can a GST officer arrest a businessman, and what safeguards exist?
Yes, but only within defined limits. Under Section 69, the Commissioner must record reasons to believe that a person has committed one of the serious specified offences, chiefly fake invoicing and evasion beyond the prosecution thresholds, before authorising arrest. For cognizable, non-bailable cases, the person must be produced before a Magistrate within twenty-four hours; for bailable offences, the Deputy or Assistant Commissioner can grant bail. Departmental instructions require that arrest is not routine and must be justified by factors like flight risk or evidence tampering. My GST registration was rejected in REG-05 after a clarification notice. Can I apply again?
Yes. A rejection order in Form REG-05 does not bar you from applying afresh. You can file a new registration application after curing the defects the officer pointed out, such as an incomplete rental agreement, mismatched address proof or missing authorisation letter. Alternatively, if you believe the rejection was wrong, you can challenge the order by filing an appeal in Form APL-01 within three months. How do I reply to a DRC-01 show cause notice online?
The reply to a show cause notice summarised in DRC-01 is filed in Form DRC-06 on the GST portal. A good DRC-06 addresses each allegation separately, annexes reconciliations, invoices and ledgers, cites the relevant provisions and circulars, and raises limitation and jurisdiction objections where available. I received a DRC-01 notice for ITC mismatch between GSTR-3B and GSTR-2A. How do I defend it?
Start with a supplier-wise reconciliation identifying why each credit is missing from GSTR-2A, such as the supplier filing late, quoting a wrong GSTIN or reporting B2B supplies as B2C. For FY 2017-18 and 2018-19, CBIC Circular 183/15/2022 permits proving genuine credits through supplier certificates or CA certificates, which resolves many Padi cases. Attach tax invoices, payment proofs and ledger extracts to your DRC-06 reply to establish that the conditions of Section 16 were met. Where a supplier has genuinely defaulted, quantify and pay only that portion through DRC-03 rather than conceding the entire demand.
How often should I get a GST health check done for my business?
At minimum once a year, ideally between September and December, because that window still allows you to correct the previous financial year through the November return-amendment deadline and finalise a clean GSTR-9 by its 31 December due date. Businesses with turnover above Rs.5 crore, multiple registrations or heavy ITC should review quarterly, since e-invoice obligations and larger credit volumes raise the stakes. A health check is also wise before events such as applying for a large refund, receiving an ADT-01 audit intimation, or a business sale, when past compliance suddenly gets examined closely. Consistency matters more than frequency.
Does buying from unregistered dealers attract reverse charge for everyone?
No. The general reverse charge on all unregistered purchases under Section 9(4) was never fully implemented and now applies only to notified classes, principally real estate. A promoter must procure at least eighty percent of inputs and input services from registered suppliers for a project; on any shortfall, the promoter pays 18 percent under RCM, and cement purchased from an unregistered dealer attracts RCM at the rate applicable to cement, 18 percent since the September 2025 rate rationalisation reduced it from 28 percent, irrespective of the eighty percent test. Transfer of development rights and long-term leases to promoters are also covered. An ordinary trader or service provider in Padi buying stationery from an unregistered shop has no Section 9(4) liability at all.
How much time do I get to raise an invoice for services?
A tax invoice for services must be issued within thirty days from the date of supply of the service. For banks, insurers, financial institutions and NBFCs, the limit is forty-five days. Where services are supplied continuously, the invoice follows the contract: if the due date of payment is ascertainable, invoice on or before that date; if not, invoice when payment is received; and if payment is linked to completion of an event or milestone, invoice on or before its completion. Consultants and agencies that bill quarterly should check their contracts against these rules, since late invoicing defers nothing legally.
Which daily-use grocery items became cheaper under GST from September 2025?
The 56th GST Council's rationalisation, effective 22 September 2025, moved a large basket of daily essentials from 12% or 18% down to 5%, including butter, ghee, cheese, namkeens, sauces, pasta, chocolates, biscuits, cornflakes, hair oil, shampoo, soaps and toothpaste. UHT milk, pre-packaged paneer and all Indian breads such as roti, chapati and paratha became nil rated. Aerated and caffeinated beverages, by contrast, went to the 40% demerit rate. Grocery and supermarket billing masters needed a near-complete refresh from that date, and old stock is simply sold at the new rate applicable on the date of supply.
I hold stock purchased before the September 2025 rate cuts at higher tax rates. What happens when I sell it now?
You charge the rate in force on the date of supply, so goods sold on or after 22 September 2025 carry the new lower rate even if you bought them when the rate was 12% or 28%. The input tax credit you took at the old, higher rate remains fully intact in your credit ledger and is not restricted merely because output is now taxed lower; it simply sets off across your overall liability.
