A consignment of power weeders was intercepted on 6 March 2023 at about 10.30 a.m., the e-way bill having expired at 11.59 p.m. the previous night. The taxpayer pleaded a vehicle breakdown. The Court declined to interfere, noting that the validity could have been extended within the permitted window and had not been, and that the officer's decision to detain and penalise under Section 129(1) was not unreasonable. The writ petition was dismissed with liberty to file a statutory appeal.
How we apply it: Chennai transporters must extend e-way bill validity within the permitted window when a vehicle breaks down; the High Court will not excuse an expired bill merely because of a breakdown.
Notification No. 03/2017-Central Tax dated 19.06.2017 · 2017-06-19
This notification made the Central Goods and Services Tax Rules, 2017. In its original form it carried the chapters on preliminary definitions, composition levy and registration, together with the associated forms in the REG and CMP series. Every later amendment to the GST rules, from e-way bills to input tax credit restrictions to annual return formats, is technically an amendment to the rules notified here.
What to do about it: When a Chennai officer cites a rule number, this is the parent notification, and the rule must be read as it stood on the date of your transaction, not as it reads today.
GSTN Advisory dated 31 August 2023 — Electronic Credit Reversal and Re-claimed Statement · 2023-08-31
GSTN introduced the Electronic Credit Reversal and Re-claimed Statement on the portal to track credit reversed in Table 4B(2) of GSTR-3B and later reclaimed in Tables 4D(1) and 4A(5). It applied from the August 2023 return for monthly filers and from the July to September 2023 quarter for quarterly filers. The cumulative opening balance of reversals awaiting reclaim had to be reported by 30 November 2023, with up to three amendments allowed until 31 December 2023. The portal now warns when reclaimed credit exceeds the available balance.
What to do about it: Maintain a running register of credit reversed and reclaimed, because the portal flags excess reclaims and the data feeds departmental scrutiny.
