Notification No. 09/2021-Central Tax · 2021-05-01

The late fee under Section 47 for GSTR-3B was waived for the March and April 2021 tax periods, later extended to May 2021, for a specified number of days beyond the due date. Taxpayers with turnover above Rs 5 crore received a fifteen-day waiver while smaller taxpayers received thirty days, with a corresponding waiver for quarterly filers of the January to March 2021 quarter. Beyond the waived window the ordinary late fee applied from the original due date.

Practical effect: Returns for March to May 2021 filed within the extended window carry no late fee, and portal-generated demands for those months are frequently overstated.

Renting to unregistered individuals for residence remains fully exempt. There is a carve-out from 1 January 2023: a proprietor renting a dwelling in his personal capacity for use as his own residence, on his own account and not for the business, is exempt. Companies and firms renting flats, including for guest houses, must therefore pay RCM monthly through GSTR-3B. We correct many such missed entries during our compliance health checks.
What is the 180-day payment rule for input tax credit?
Under the second proviso to Section 16(2) read with Rule 37, if you do not pay your supplier the invoice value including tax within 180 days from the invoice date, you must reverse the proportionate ITC in GSTR-3B, along with interest at 18 percent per annum from the date of availment. The credit can be re-availed, without any time limit, once payment is actually made. If you file GSTR-1 after the 11th, your invoices miss that month's GSTR-2B and your customer's credit gets pushed to the next month, straining his working capital. Repeated delays lead buyers to withhold the GST portion of payments or move to more compliant vendors. Timely GSTR-1 filing is therefore a commercial necessity, not just a legal one.
