Where an appellate authority, tribunal or court holds that a notice issued under Section 74 is not sustainable because fraud, wilful misstatement or suppression of facts is not established, Section 75(2) requires the proper officer to re-determine the tax as though the notice had been issued under Section 73. The Board clarified that this re-determination must be completed within two years from the date of communication of that order, and only the normal period demand can survive.

Practical effect: Winning on the suppression point in appeal does not end the matter, but it limits the surviving Chennai demand to the normal period and starts a two-year clock on the department.

Rule 164 amended: partial-period demands can still use the Section 128A amnesty

Notification No. 11/2025-Central Tax · 2025-03-27

CBIC amended Rule 164 to resolve a practical roadblock in the Section 128A scheme. Where a single notice or order spans FY 2017-18 to 2019-20 as well as periods outside the scheme, the taxpayer may pay the tax attributable only to the covered period and need not withdraw the whole appeal, a new proviso permitting partial withdrawal limited to the covered period while the appeal continues for the balance. The amendment also confirms that no refund arises for tax, interest or penalty already discharged for the entire period.

What to do about it: A demand order mixing amnesty-eligible and other years no longer forces an all-or-nothing choice; the waiver can be taken for 2017-20 while litigating the rest.

Filing of appeals is mandatorily electronic, and advisories prescribe a phased, staggered schedule so that the backlog does not congest the system, with backlog appeals against pre-existing orders permitted to be filed up to 30 June 2026.

Section 83 empowers the Commissioner, where he records an opinion that protecting revenue requires it, to provisionally attach property including bank accounts during the pendency of specified proceedings, such as assessment, inspection or demand cases. The attachment order is issued in Form DRC-22 and a copy goes to your bank, which freezes debits. Crucially, the attachment automatically ceases to have effect after one year from the order, and it can be lifted earlier through Form DRC-23 if the Commissioner is satisfied. Courts insist the power is draconian and must be exercised with genuine, recorded reasons, which is a strong ground of challenge in suitable cases.
My GST registration was rejected in REG-05 after a clarification notice. Can I apply again?
Yes. A rejection order in Form REG-05 does not bar you from applying afresh. You can file a new registration application after curing the defects the officer pointed out, such as an incomplete rental agreement, mismatched address proof or missing authorisation letter. Alternatively, if you believe the rejection was wrong, you can challenge the order by filing an appeal in Form APL-01 within three months. At what amount of tax evasion can GST prosecution be launched?

Form REG-17 is issued when the officer proposes to cancel your registration, commonly for continuous non-filing of returns, non-existence at the declared premises or wrongful ITC availment. You must reply in Form REG-18 within seven working days and attend the hearing if one is fixed. If the reply satisfies the officer, proceedings are dropped in REG-20; otherwise cancellation is ordered in REG-19. If cancellation happens, you can seek revocation in Form REG-21 within ninety days after filing all pending returns and paying dues. Because cancelled registrations freeze e-way bills and invoicing, treat a REG-17 in Padi as urgent.
What is Form DRC-03 and when should I use it?
DRC-03 is the form for making a voluntary payment of tax, interest or penalty on the GST portal, either before a show cause notice is issued or within thirty days of receiving one. Under GST, a works contract relating to immovable property is treated wholly as a supply of services, and the standard rate is 18 percent on the contract value, with the contractor eligible for input tax credit on cement, steel and other inputs.
