Specified goods supplied to holders of petroleum exploration licences, mining leases and coal-bed methane contracts had enjoyed a concessional rate of five per cent under Notification No. 3/2017-Central Tax (Rate) subject to certificate conditions. This notification raised that concessional rate to twelve per cent with effect from 18 July 2022, following the Council's decision to trim rate concessions that were creating credit accumulation. The certificate and end-use conditions of the parent notification continued unchanged.

Telangana AAAR reverses tax on solar project liquidated damages

Achampet Solar Pvt Ltd — AAAR Telangana, Order No. AAAR.COM/04/2022, dated 19 October 2022 (setting aside AAR Order No. 07/2022, dated 16 February 2022) · 2022-10-19

The Telangana AAR had held that liquidated damages recoverable by Achampet Solar from its contractor for delay in commissioning its solar plant were a taxable supply attracting 18 per cent GST. The Appellate Authority set that ruling aside on 19 October 2022, holding that such damages are compensation for breach of contract and not consideration for tolerating an act, so they do not qualify as a supply. The decision aligns with CBIC Circular No. 178/10/2022-GST dated 3 August 2022 on contractual damages.

What it means for you: Do not automatically charge GST on liquidated damages or penalty recoveries; test each clause against the 2022 circular before paying tax.

I have been charging the wrong GST rate on my invoices. How do I fix it?
The correction depends on the direction of the error. If you charged a higher rate than applicable, the excess tax collected must still be paid to the government under Section 76, or you can issue credit notes to customers within the permitted time and adjust the tax. If you charged a lower rate, the shortfall is your liability: pay the differential tax with interest at 18 percent per annum through your returns or Form DRC-03, and issue debit notes to registered buyers so they can take the additional credit. What penalties does Section 122 of the CGST Act prescribe, and for which offences?

If no order has been passed yet, file a belated reply with a condonation request explaining the delay and appear at the personal hearing; officers frequently take late replies on record before adjudicating. If an ex parte order has already been issued, you can file an appeal in Form APL-01 within three months of the order, paying the mandatory pre-deposit of 10 percent of the disputed tax. How long can a departmental GST audit under Section 65 go on?
The law requires the audit to be completed within three months from its commencement, which is the date the officers receive all the records they asked for. Where the Commissioner is satisfied that the audit cannot be completed in that time, he may record reasons and extend it by a further period not exceeding six months. In practice, audits drag when taxpayers supply records piecemeal, so submitting a complete, indexed set of documents at the start actually shortens the exercise. Track every submission with an acknowledgment, because the commencement date and the timeline arguments may matter later if disputes arise.
What is Form DRC-03 and when should I use it?
DRC-03 is the form for making a voluntary payment of tax, interest or penalty on the GST portal, either before a show cause notice is issued or within thirty days of receiving one. It is commonly used to pay liabilities found during a self-review, to respond to a DRC-01A intimation, to settle audit findings, or to pay dues flagged in scrutiny. Paying through DRC-03 under Section 73 before the notice, along with interest, means no penalty and no notice on that amount.
