A printing house printed leaflets and similar material using content supplied by the customer but paper, ink and other physical inputs of its own. It asked for the correct classification and rate. The Authority held that this is a composite supply in which the printing service is the principal supply, and the supply is therefore taxable at 18 percent. The customer supplying only the content or artwork did not alter the classification.

What it means for you: A Chennai printer supplying its own paper should charge 18 percent on job printed leaflets instead of assuming a lower book rate.

Expired e-way bill not extended in time — penalty upheld and writ petition dismissed

M/s. Ajay Agency v. State Tax Officer — Madras High Court, W.P. No. 8507 of 2023, decided 30 March 2023 (Anita Sumanth J.) · 2023-03-30

A consignment of power weeders was intercepted on 6 March 2023 at about 10.30 a.m., the e-way bill having expired at 11.59 p.m. the previous night. The taxpayer pleaded a vehicle breakdown. The Court declined to interfere, noting that the validity could have been extended within the permitted window and had not been, and that the officer's decision to detain and penalise under Section 129(1) was not unreasonable. The writ petition was dismissed with liberty to file a statutory appeal.

What to do about it: Chennai transporters must extend e-way bill validity within the permitted window when a vehicle breaks down; the High Court will not excuse an expired bill merely because of a breakdown.

GSTN introduced a new RCM Liability and ITC Statement on the portal so that reverse charge tax declared in Table 3.1(d) of GSTR-3B can be matched against the corresponding credit claimed in Table 4A(2) and 4A(3). It applies from the August 2024 tax period for monthly filers and from the July to September 2024 quarter for taxpayers under the quarterly scheme. Taxpayers were required to report an opening balance of reverse charge liability paid but credit not yet claimed, or credit claimed without payment, within the window announced by GSTN.

Why is the portal not letting me file GSTR-1?

What is the place of supply for freight and courier charges on goods?
For transportation of goods, including by courier, Section 12(8) fixes the place of supply as the location of the recipient where the recipient is registered. Where the recipient is unregistered, it is the location where the goods are handed over for transportation. So a registered Park Town manufacturer paying a transporter for a Chennai-to-Delhi movement has Tamil Nadu as the place of supply, and the RCM liability is paid as CGST plus SGST if the transporter is also in Tamil Nadu. What is the GST rate for restaurants and food delivery now?
Standalone restaurants, eateries and cloud kitchens charge 5 percent GST without input tax credit. Restaurants located in hotels where the room tariff exceeds Rs.7,500 per day fall in the specified premises category and charge 18 percent with input tax credit. Food ordered through e-commerce operators such as Swiggy and Zomato is taxed at 5 percent, with the platform liable to pay the tax on restaurant services supplied through it.
