This circular answered a set of unrelated questions. The most important is that the penalty under section 73(11) does not apply where self-assessed tax shown in the return is paid late; only interest under section 50 and, where warranted, general penalty under section 125 arise. It also dealt with the rate applicable to notes issued under section 142(2) and who is the owner of goods in transit. A corrigendum of 7 March 2019 clarified that tax collected at source under the Income-tax Act is not included in the taxable value.
What to do about it: If a demand adds a heavy penalty simply because GSTR-3B tax was paid late, this circular is the answer.

The applicant sold packaged ready to cook instant mixes for dosai, idli, tiffin items, sweets, health mix and porridge. It argued that these were only flours of cereals and pulses taxable at 5 percent. The Authority classified the products under heading 2106 90 as food preparations not elsewhere specified, attracting 18 percent GST, because the mixing and added ingredients took them out of the concessional flour entries. The Appellate Authority upheld that classification.

GSTN Advisory, January 2024 — introduction of Tables 14 and 15 in GSTR-1 and the Invoice Furnishing Facility · 2024-01
From the January 2024 tax period, GSTR-1 and the Invoice Furnishing Facility carry two additional tables. Table 14 is filed by the seller and splits supplies made through an e-commerce operator between those on which the operator collects tax at source under Section 52 and those on which the operator itself pays tax under Section 9(5). Table 15 is filed by the e-commerce operator for supplies on which it discharges the tax under Section 9(5).
What it means for you: Sellers on marketplaces must map each order to the correct table, because mismatches here drive notices on tax collected at source credit.
