The Andhra Pradesh High Court upheld the constitutional validity of Section 16(4) CGST Act, which bars availment of input tax credit after the prescribed deadline, holding that ITC is a conditional concession and the time limit is neither violative of Articles 14, 19 or 300A nor overridden by the non-obstante acceptance of a belated return with late fee. Parliament subsequently granted relief through Section 16(5), retrospectively extending the deadline for FY 2017-18 to 2020-21 up to 30 November 2021.

CBIC clarified the reverse charge entry for renting motor vehicles designed to carry passengers where the cost of fuel is included in the consideration. Where the supplier is a person other than a body corporate who charges tax at five per cent without claiming input tax credit, and the recipient is a body corporate located in the taxable territory, the recipient pays the tax under reverse charge. Where the supplier is itself a body corporate, or charges the twelve per cent rate with credit, the reverse charge does not apply.

Where the liability declared in GSTR-1 for a tax period exceeds the liability paid through GSTR-3B beyond the prescribed limit, the system issues an intimation in Form GST DRC-01B. The taxpayer must either pay the difference with interest through Form DRC-03 or file a reply in Part B of DRC-01B explaining the reasons, within seven days. If no action is taken, the next GSTR-1 cannot be filed.
