Invoices had been raised showing the GSTIN of a group company instead of the actual recipient, which prevented the recipient from claiming credit. The High Court held the mistake was bona fide and inadvertent, applied Circular No. 183/15/2022-GST, and directed the authorities to permit rectification of the invoices and the corresponding returns for 2017-18 and 2018-19, and extended the same benefit to 2019-20 taking a justice-oriented approach.
Why this matters: A wrong GSTIN or similar clerical error in old invoices is not necessarily fatal — a rectification request supported by this judgment and Circular 183 is worth pursuing.
Notification No. 9/2025-Central Tax (Rate), dated 17 September 2025, Schedules IV, V and VI · 2025-09-17
Schedule IV at 1.5 per cent central tax, that is three per cent combined, covers pearls, silver, gold, platinum, base metals clad with precious metal, articles of jewellery, goldsmiths' and silversmiths' wares, imitation jewellery and coin. Schedule V at 0.125 per cent, that is 0.25 per cent combined, covers rough or simply sawn diamonds and unworked precious and semi-precious stones. Schedule VI at 0.75 per cent, that is 1.5 per cent combined, covers cut and polished diamonds and worked synthetic stones.
Why this matters: Jewellers in Chennai continue to charge three per cent on ornaments, with the separate making charge taxed as a service, so no repricing was needed in September 2025.
Circular No. 142/12/2020-GST dated 9 October 2020 · 2020-10-09
As a Covid relief measure, the rule 36(4) credit restriction was not applied separately for each of the tax periods February to August 2020. CBIC clarified that the taxpayer must instead apply the restriction cumulatively for those seven months while filing the GSTR-3B for September 2020, comparing the aggregate credit taken with the aggregate credit reflected in GSTR-2A for that whole span, and reversing any excess in that return.
What to do about it: Any scrutiny of credit for the first Covid year must be tested cumulatively for February to August 2020, not month by month.
