The Supreme Court held that the doctrine of mutuality survived the Forty-sixth Constitutional Amendment. Supplies of food, drink and services by an incorporated members' club to its own members are not a sale or a service to another person, so sales tax and service tax could not be levied. Note that GST law was later amended, with retrospective effect from 1 July 2017, to specifically tax supplies between a club or association and its members.

To cure the inverted duty structure in which fabric makers paid more tax on yarn and dyes than they collected on cloth, the Government notified an increase from five per cent to twelve per cent across man-made fibre, yarn, fabrics, garments and made-ups, and removed the value-based split on footwear so that all footwear would attract twelve per cent. The change was to take effect from 1 January 2022 and triggered strong protests from the textile trade, including in Tiruppur, Erode and Coimbatore.
Why this matters: This notification is the origin of the textile rate fight, and its history matters when defending classification and rate positions for supplies made around that period.

CBIC found that persons whose registration had been cancelled for non-compliance were applying for a brand new registration rather than seeking revocation. Officers were directed to examine every fresh application closely, to check whether the applicant had an earlier registration at the same place of business, and to reject the application under rule 9 if the true purpose was to avoid the pending returns and dues attached to the old registration.
