This circular settled several long-running food service disputes. It clarified that service by cloud kitchens and central kitchens is restaurant service attracting 5 per cent without input tax credit, while ice cream parlours that sell already manufactured ice cream without any element of cooking supply goods and attract the applicable goods rate with credit. It also clarified the treatment of coaching services supplied under a government scholarship scheme, overloading charges recovered at toll plazas, and services in relation to admission to amusement parks.
What to do about it: A Chennai cloud kitchen bills at 5 per cent without credit, but an ice cream parlour selling tubs and cones must charge the goods rate and can keep its credits.
GSTN Advisory dated 7 June 2025 — non-editable auto-populated liability in GSTR-3B · 2025-06-07
After an October 2024 advisory and a January 2025 deferment, GSTN confirmed that from the July 2025 tax period the auto-populated outward tax liability in GSTR-3B, drawn from GSTR-1, IFF or GSTR-1A, is hard-locked and cannot be edited manually while filing. Any correction to sales figures must be made through GSTR-1A before GSTR-3B is filed. The change is intended to end mismatches between GSTR-1 and GSTR-3B.
Why this matters: Reconcile sales data before filing GSTR-1 each month, since GSTR-3B can no longer be adjusted at the last minute.
State Tax Officer v. Rainbow Papers Ltd — Supreme Court, judgment dated 06-09-2022 · 2022-09-06
The Supreme Court held that where a State tax statute creates a first charge on the assets of a defaulting dealer, the tax department qualifies as a secured creditor under the Insolvency and Bankruptcy Code. A resolution plan that simply ignores statutory tax dues, or provides nil recovery to the State, can be rejected. The decision considerably strengthened the position of tax authorities in corporate insolvency resolution processes.
Why this matters: A Chennai company entering insolvency cannot assume its GST and VAT arrears will be wiped out; statutory dues must be properly dealt with in the resolution plan.
