Summing up a long debate over five-band and six-band options, the Chairperson proposed and the Council accepted a structure with one exempt category covering food grains and similar essentials, a lower rate of five per cent for goods consumed by vulnerable sections, standard rates of 12 and 18 per cent, and a higher slab of 28 per cent. A committee of officers was directed to fit individual goods and services into those slabs. Proposals for a 40 per cent slab were rejected.

The company made bona fide clerical errors in its GSTR-1 which prevented its customer from taking credit, and the portal would not permit correction after the statutory deadline had passed. The High Court held that GST is a technology-driven regime intended to be taxpayer-friendly, that a genuine error causing no loss of revenue ought to be permitted to be corrected, and directed the authorities to allow rectification of the returns for the relevant period.

Three companion notifications rebuilt the late fee structure on a turnover basis from June 2021. For GSTR-1 the fee was capped at Rs 500 for nil statements, Rs 2,000 where turnover is up to Rs 1.5 crore and Rs 5,000 where turnover is between Rs 1.5 crore and Rs 5 crore, with the normal Rs 10,000 ceiling continuing above Rs 5 crore. For the composition annual return in GSTR-4, from the financial year 2021-22 onwards, the fee was capped at Rs 2,000 in total, being Rs 1,000 each under the central and State laws, and at Rs 500 in total where the return is nil. For the tax deduction return in GSTR-7 the fee was reduced to Rs 50 per day subject to a ceiling of Rs 2,000.
What to do about it: Small Chennai taxpayers can no longer face runaway late fee running into lakhs, because every return type now carries an absolute ceiling.
