The Maharashtra AAR held that liquidated damages recovered by MAHAGENCO from contractors for delayed completion of works are consideration for tolerating an act under Schedule II entry 5(e) of the CGST Act, classifiable under heading 9997 and taxable at 18 per cent. The AAAR upheld this view. The ruling drove years of demands on contract penalties, until CBIC Circular No. 178/10/2022-GST dated 3 August 2022 substantially narrowed the taxability of such recoveries by clarifying that genuine compensation for breach is not payment for tolerating an act.
Practical effect: Review old contracts where GST was paid or demanded on penalties and delay damages, as later clarifications may support refunds or defence against demands.
Rules 96(10), 89(4A) and 89(4B), CGST Rules, 2017, omitted by Notification No. 20/2024-Central Tax · 2024-10-08
Rule 96(10) had barred exporters who imported inputs without paying IGST, typically under Advance Authorisation or EPCG, from exporting on payment of IGST and claiming refund of that tax. Rules 89(4A) and 89(4B) prescribed a restrictive formula for their credit refunds. All three were omitted with prospective effect from 8 October 2024, removing a provision that had generated a large volume of recovery notices against exporters.
What to do about it: Exporters may follow the with-payment refund route for shipments made from 8 October 2024, though demands for earlier periods survive and still need to be defended.

The Madras High Court partly allowed the petition, sustaining the seizure but modifying the prohibition order and directing provisional release of the goods on a personal bond plus a deposit of Rs. 2 lakh. The Court noted that the officers had not produced the material on which their reason to believe was founded, and took into account the severe business disruption caused by the pandemic.
Practical effect: Seized stock can often be released provisionally on bond and a modest deposit while the investigation continues, instead of remaining locked up indefinitely.
