How officers must handle GSTR-3B versus GSTR-2A ITC mismatches for 2019-2021

Circular No. 193/05/2023-GST · 2023-07-17

CBIC extended the Circular 183 verification mechanism to the period 1 April 2019 to 31 December 2021, when Rule 36(4) allowed limited extra credit beyond GSTR-2A. Where the ITC claimed in GSTR-3B exceeded GSTR-2A beyond the permitted margin, officers must seek supplier-wise certificates or CA certification confirming the supplies were genuine and tax was paid, instead of mechanically demanding reversal of the entire difference.

Practical effect: For ASMT-10 or DRC-01 notices on 2019-2021 ITC mismatches, supplier certificates and CA certification as per this circular are the prescribed defence, so gather them before replying.

Notification No. 44/2019-Central Tax dated 09.10.2019 · 2019-10-09

This notification prescribed that the return in FORM GSTR-3B for each of the months from October 2019 to March 2020 was to be furnished electronically on or before the twentieth day of the month succeeding the month concerned, and that the tax due had to be discharged by debiting the electronic cash or credit ledger not later than the same date. It continued the practice of notifying GSTR-3B due dates in six month blocks.

The department has provisionally attached my bank account under Section 83. What does that mean?

Section 132 links punishment to the amount involved: imprisonment up to five years with fine where the tax evaded or credit misused exceeds Rs.5 crore, up to three years where it exceeds Rs.2 crore, and up to one year for the Rs.1 crore to Rs.2 crore band, which after the Finance Act 2023 changes survives only for the offence of issuing invoices without supply. A repeat conviction can attract up to five years regardless of amount. Offences involving supply without invoice, invoices without supply, credit from such invoices, and collected-but-not-deposited tax are cognizable and non-bailable when the amount exceeds Rs.5 crore; everything else is non-cognizable and bailable. Courts take cognizance only with the Commissioner's previous sanction.
What happens if I do not reply to an ASMT-10 scrutiny notice?
If no satisfactory explanation is filed within thirty days, or you fail to correct the discrepancies, the officer can escalate the matter to a departmental audit under Section 65, a special audit under Section 66, an inspection under Section 67, or straightaway initiate a demand under Section 73 or Section 74. In practice, unanswered ASMT-10 notices convert into DRC-01A intimations and then show cause notices, where penalties and hearings enter the picture. Replying at the scrutiny stage is the cheapest point to close an issue, because you are only explaining, not yet defending a demand. Do not let the window lapse.
What is the difference between a Section 73 and a Section 74 notice?
Section 73 covers short payment of tax or wrong ITC without fraud, while Section 74 applies where the department alleges fraud, wilful misstatement or suppression of facts to evade tax. The stakes differ sharply. Under Section 73 the order must be passed within three years from the annual return due date and the penalty is 10 percent of the tax or Rs.10,000, whichever is higher, with no penalty if you pay before the notice. How long can a departmental GST audit under Section 65 go on?
The law requires the audit to be completed within three months from its commencement, which is the date the officers receive all the records they asked for. Where the Commissioner is satisfied that the audit cannot be completed in that time, he may record reasons and extend it by a further period not exceeding six months. In practice, audits drag when taxpayers supply records piecemeal, so submitting a complete, indexed set of documents at the start actually shortens the exercise. Proprietorships, partnerships, HUFs and trusts can freely use EVC, an OTP sent to the authorised signatory's registered mobile and email. The DSC must be a Class 3 signature registered on the portal against the signatory's PAN. If a company's filings fail at the signing step, an expired or unregistered DSC is the usual culprit.
Is GST payable under reverse charge on payments made to our company directors?
It depends on the capacity in which the director is paid. CBIC Circular 140/10/2020 settles the position: remuneration to a whole-time or executive director who is an employee, paid as salary with TDS under Section 192, is outside GST entirely as an employer-employee transaction. In contrast, sitting fees, commission and professional charges paid to independent or non-executive directors, typically suffering TDS under Section 194J, are taxable and the company pays 18 percent under reverse charge, claiming ITC. A promoter must procure at least eighty percent of inputs and input services from registered suppliers for a project; on any shortfall, the promoter pays 18 percent under RCM, and cement purchased from an unregistered dealer attracts RCM at the rate applicable to cement, 18 percent since the September 2025 rate rationalisation reduced it from 28 percent, irrespective of the eighty percent test. Transfer of development rights and long-term leases to promoters are also covered.
