The Supreme Court dismissed the department's SLP, enhanced costs payable to the taxpayer, and confirmed that tax evasion intent is essential before penalising technical e-way bill lapses.
What it means for you: If your consignment is detained for an expired e-way bill caused by genuine transit delays, contest the penalty — courts require proof of intent to evade, not just the lapse.

CBIC waived the late fee for furnishing the outward supply statement in Form GSTR-1 for the months of March, April and May 2020 and for the quarter ending 31 March 2020, provided the statement was filed on or before 30 June 2020. The relief covered both monthly and quarterly filers. Because GSTR-1 late fee is separate from GSTR-3B late fee, this notification had to be issued in addition to the GSTR-3B waiver of the same date.
What it means for you: A Chennai supplier who filed the March to May 2020 GSTR-1 by 30 June 2020 owes nothing by way of late fee, whatever the portal ledger may currently show.

CBIC listed six situations that must not attract detention proceedings where both an invoice and an e-way bill accompany the goods: a spelling mistake in the consignor or consignee name where the GSTIN is correct, a wrong PIN code where the address is correct, an error in one or two digits of the document number, an error in the fourth or sixth digit of the HSN where the rate is right, and an error in the vehicle number. Penalty is only Rs 500 each under CGST and SGST in FORM GST DRC-07.
What it means for you: A typing slip in an e-way bill should cost Rs 1,000, not a section 129 demand of tax and penalty, and this circular is the first thing to quote in reply.
