CBIC clarified three recurring place-of-supply questions. For transportation of goods, including by mail or courier, where the supplier or the recipient is outside India, Section 13(9) of the IGST Act stood omitted from 1 October 2023, so the place of supply is now fixed by the default rule in Section 13(2), namely the location of the recipient. For advertising services supplied to a government body, the place of supply follows the location of the recipient under Section 12(2) rather than the location of the hoardings, with State-wise allocation where the contract provides for it. For co-location of servers in a data centre, the supply is a bundle of hosting services and not a letting of immovable property, so the recipient's location governs.

The press release recorded that e-invoicing would help taxpayers with backward integration and automation of tax-relevant processes and would help authorities combat evasion, with Phase 1 proposed to be voluntary and rolled out from January 2020. This decision is the origin of the Invoice Registration Portal, the IRN and the QR code now mandatory for most mid-sized and large businesses.

Form REG-17 is issued when the officer proposes to cancel your registration, commonly for continuous non-filing of returns, non-existence at the declared premises or wrongful ITC availment. You must reply in Form REG-18 within seven working days and attend the hearing if one is fixed. If the reply satisfies the officer, proceedings are dropped in REG-20; otherwise cancellation is ordered in REG-19. If cancellation happens, you can seek revocation in Form REG-21 within ninety days after filing all pending returns and paying dues. Because cancelled registrations freeze e-way bills and invoicing, treat a REG-17 in Porur as urgent.

Following the Finance Act 2023 amendments, prosecution under Section 132 is generally launched only where the amount of tax evaded, or input tax credit wrongly availed or utilised, exceeds Rs.2 crore, raised from the earlier Rs.1 crore. The important exception is the offence of issuing invoices without any actual supply of goods or services, where the lower threshold continues, reflecting the government's focus on fake billing networks. The same amendments also decriminalised certain lesser offences, including obstruction of an officer and failure to supply information. Prosecution is in addition to, not instead of, the monetary penalties and demand proceedings.
What happens if I ignore a GSTR-3A notice from the GST department?
If the return is not filed within fifteen days, the officer can complete a best judgment assessment under Section 62 and pass an order in Form ASMT-13, estimating your liability from GSTR-1 data, e-way bills and bank information. Such estimates are usually far higher than the actual dues. The assessment is deemed withdrawn if you file the valid return within sixty days of the order, on payment of late fee and interest. I returned an advance because the deal was cancelled. What document do I issue?
It depends on how far the paperwork went. If you had issued only a receipt voucher and no tax invoice, you issue a refund voucher under Rule 51 when returning the advance, and the tax paid on that advance can be adjusted. If a tax invoice had already been issued, the cancellation is handled through a credit note under Section 34 instead. The refund voucher records the original receipt voucher reference, the amount refunded and the tax involved. Are any goods exempt from GST when transported by a GTA?
Yes. Transport by a GTA of agricultural produce, milk, salt and foodgrains including flours and pulses, organic manure, newspapers and magazines registered with the Registrar of Newspapers, relief materials for victims of calamities, and defence or military equipment is exempt regardless of freight value. Note that the older exemptions for small consignments, Rs.1,500 for a full truckload and Rs.750 for a single consignee, were withdrawn with effect from 18 July 2022, so ordinary cargo enjoys no value-based relief now. Transporters serving agricultural markets should describe the produce accurately on the consignment note to support the exemption.
How is GST charged on clothes and footwear after the rate change?
The rate now turns on a per-piece price line of Rs.2,500. Apparel, made-up textile articles and footwear with a sale value up to Rs.2,500 per piece attract 5 percent GST, while pieces priced above Rs.2,500 attract 18 percent. The test applies item by item, so a single invoice from a garment shop in Porur can carry both rates: a Rs.1,800 shirt at 5 percent and a Rs.4,000 pair of shoes at 18 percent on the same bill. Section 14 of the CGST Act decides this by looking at three events: the date of supply, the date of invoice and the date of payment. Broadly, if any two of the three events fall after the rate change, the new rate applies; if two fall before, the old rate applies.
