The maximum pre-deposit for a first appeal under Section 107 was reduced from Rs 25 crore to Rs 20 crore each of CGST and SGST, the rate remaining ten per cent of the disputed tax. For appeals to the GST Appellate Tribunal, the pre-deposit was reduced from twenty per cent to ten per cent of the disputed tax, subject to a ceiling of Rs 20 crore each of CGST and SGST, in addition to the amount already deposited at the first appellate stage.
Practical effect: A second appeal to the Tribunal now costs ten per cent rather than twenty per cent of the disputed tax, making it far more affordable to carry a bad order forward.
Achampet Solar Pvt Ltd — AAAR Telangana, Order No. AAAR.COM/04/2022, dated 19 October 2022 (setting aside AAR Order No. 07/2022, dated 16 February 2022) · 2022-10-19
The Telangana AAR had held that liquidated damages recoverable by Achampet Solar from its contractor for delay in commissioning its solar plant were a taxable supply attracting 18 per cent GST. The Appellate Authority set that ruling aside on 19 October 2022, holding that such damages are compensation for breach of contract and not consideration for tolerating an act, so they do not qualify as a supply. The decision aligns with CBIC Circular No. 178/10/2022-GST dated 3 August 2022 on contractual damages.
Why this matters: Do not automatically charge GST on liquidated damages or penalty recoveries; test each clause against the 2022 circular before paying tax.

The Board amended its earlier instruction on proper officers so that show cause notices issued by the Directorate General of GST Intelligence are adjudicated by specified Additional or Joint Commissioners of designated Commissionerates. Where a single investigation covers several taxpayers spread across different States, one officer now adjudicates the whole case instead of each jurisdiction passing its own order. The change is meant to avoid conflicting decisions and multiple parallel proceedings on the same set of facts.
