Several appellate authorities were refusing to decide appeals on the ground that the GST Appellate Tribunal did not exist. CBIC clarified that this is not a valid reason to defer disposal, and that under the Removal of Difficulty Order the three-month period for filing an appeal to the Tribunal starts only from the date on which the President of the Tribunal enters office. Appellate authorities were directed to record this position in their orders so that appellants are not prejudiced.
Practical effect: A Chennai taxpayer who loses at first appeal does not lose the right to go to the Tribunal, because limitation only begins once the Tribunal is functional.
