A day before the change took effect, the Tax Research Unit issued FAQs explaining that the expression takes its meaning from the Legal Metrology Act, 2009 and covers commodities intended for retail sale in packs of up to twenty-five kilograms or twenty-five litres that must bear statutory declarations. A single package above that limit is not covered, nor are packs supplied to an industrial or institutional consumer. Loose sale from a large pack by a retailer does not attract the levy.

What to do about it: A fifty-kilogram rice bag sold as one package stays outside the levy, but the moment it is repacked into labelled retail bags of twenty-five kilograms or less, five per cent applies.

The Authority classified the product under heading 8544, which covers insulated wire and cable fitted with connectors, taxable at 9 percent central tax and 9 percent State tax following Notification No. 41/2017-Central Tax (Rate) dated 14 November 2017, the earlier rate having been higher.

My company has taken a residential flat on rent. Why is our accountant paying GST on it?
Because of a reverse charge entry effective 18 July 2022: renting of a residential dwelling to a registered person attracts 18 percent GST payable by the tenant under reverse charge, even when the landlord is unregistered. Renting to unregistered individuals for residence remains fully exempt. There is a carve-out from 1 January 2023: a proprietor renting a dwelling in his personal capacity for use as his own residence, on his own account and not for the business, is exempt. Companies and firms renting flats, including for guest houses, must therefore pay RCM monthly through GSTR-3B. We correct many such missed entries during our compliance health checks.
We add a service charge to restaurant bills. Does GST apply on that service charge?
Yes. Whatever a restaurant collects from the customer for the supply, including any service charge added to the bill, forms part of the transaction value under Section 15, so GST at 5% applies on the food value plus the service charge. The consumer-protection debate about whether a service charge can be levied at all is separate from GST; once it is charged, it is taxable. Tips paid voluntarily by the customer directly to staff, outside the bill, are not consideration for the supply and attract no GST. Which input tax credits are blocked under Section 17(5) even if they appear in GSTR-2B?
Section 17(5) blocks credit on specified items regardless of business use: motor vehicles for passenger transport with seating up to thirteen persons, unless used for resale, passenger transport or driver training; food and beverages and outdoor catering; club and fitness memberships; life and health insurance except where statutorily obligatory; works contract and construction services for immovable property other than plant and machinery; goods lost, stolen, destroyed, written off or given as gifts and free samples; and tax paid under composition. Is GST charged before or after the discount shown on my invoice?
Discounts given before or at the time of supply and recorded on the face of the invoice are excluded from the value of supply under Section 15(3)(a). How do I round off tax amounts on a GST invoice?
Section 170 of the CGST Act prescribes normal rounding to the nearest rupee: where the tax contains a part of a rupee, fifty paise or more is rounded up to one rupee, and less than fifty paise is ignored. The rounding is applied to the tax amount on each invoice, separately for each tax head, so CGST and SGST are each rounded individually rather than rounding only the invoice total.
