Where an Indian transporter supplies goods transport services to a registered Indian recipient but the destination of the goods is outside India, the proviso to Section 12(8) of the IGST Act fixed the place of supply outside India. The Board clarified that this remains an inter-State supply on which integrated tax is payable, that the supplier must report it correctly in GSTR-1, and that the Indian recipient is entitled to input tax credit. The proviso itself was later omitted with effect from 1 October 2023.

The Central Goods and Services Tax (Amendment) Rules, 2022 inserted Rule 88B, which prescribes the manner of computing interest on delayed payment of tax and on wrongly availed and utilised credit, giving statutory form to the net cash liability principle. The notification also revised Table 4 of Form GSTR-3B so that gross credit, permanent reversals and temporary reversals are reported separately, and permitted payment of tax through unified payments interface and immediate payment service.

The Board, based at the DMS Campus in Teynampet, Chennai, owned immovable property and let portions of it to government departments and business entities. It asked whether it needed registration and whether the rent was exempt because the tenant was the government. The Authority held that renting of commercial property by the Board to a government or a business entity is not an exempt supply, so GST was payable on the rent collected.

Practical effect: Chennai landlords letting premises to government offices must charge GST unless a specific exemption entry clearly covers the letting.

The resulting negative liability is carried forward automatically by the system and adjusted against the liability of subsequent tax periods, so you no longer need to defer reporting credit notes. Ensure the same credit notes are reported in GSTR-1, because GSTR-3B auto-populates from it and manual deviations invite the portal's variance flags. The portal auto-filled an interest amount in my GSTR-3B. Can I edit or dispute it?
The portal computes interest on delayed filings under Rule 88B and auto-populates it in Table 5.1 of the next period's GSTR-3B, with a break-up shown period-wise. The system value is based on your cash ledger debits and the days of delay, and while the field permits upward revision, reducing the system-computed figure will flag the return. If you believe the computation is wrong, for instance because a liability related to an earlier period was declared with correct interest already paid through DRC-03, pay what is correct and keep the working; the department can be satisfied later with the reconciliation. We hire security guards from an agency. Should they charge GST or should we pay it ourselves?
Check the agency's constitution. Since 1 January 2019, security services by way of supply of security personnel provided by any person other than a body corporate to a registered person fall under reverse charge, so your business pays the 18 percent directly and claims credit. If the agency is a body corporate, such as a private limited company, it charges GST under forward charge on its invoice. Recipients registered under the composition scheme are excluded from this reverse charge entry.
