The importer sold a range of children's toys, some containing electronic circuits and some working purely mechanically. It asked for the correct rate on each. The Authority held that toys containing electronic components attract 18 percent under the residual entry for electronic toys, irrespective of how those components are used, so children's scooters and smart tricycles with lights and music are taxed at 18 percent, while toys that work without electronics remain at 12 percent.
What to do about it: Chennai toy traders must classify item by item, because a single electronic component moves a product from 12 to 18 percent.

CBIC confirmed that the death of a sole proprietor, where the business is continued by the successor, is a transfer of business for the purposes of section 18(3), so the unutilised input tax credit can be transferred to the transferee through FORM GST ITC-02. The successor must first obtain a new registration, the cancellation application for the deceased's registration is filed selecting death of proprietor as the reason, and the transferee accepts the credit on the portal.
Why this matters: A family taking over a proprietorship after a bereavement need not lose the credit balance, provided the ITC-02 is filed before the old registration is cancelled.

The Council approved the draft CGST and IGST Bills as vetted by the Law Ministry, clearing them for introduction in Parliament. The approved design provided for State-wise single registration, a single State-wise return covering intra-State, inter-State and export supplies, registration exemption below Rs 20 lakh turnover (Rs 10 lakh in Special Category States), a composition scheme up to Rs 50 lakh, broad input tax credit entitlement, and cross-utilisation of credit between CGST, SGST, UTGST and IGST in a prescribed order.
