A landowner obtained approval to develop agricultural land into residential plots and proposed to sell the plots after laying roads, drainage, water lines and other common facilities required by the plan sanction. The Gujarat Authority for Advance Ruling held that the sale price includes the value of development works, so the transaction is a taxable supply of construction service and not a bare sale of land. CBIC later clarified that sale of land after levelling, laying drainage lines and similar works is still sale of land under Schedule III and outside GST.
Practical effect: Plot developers should read the 2022 CBIC clarification alongside older adverse rulings before conceding GST on plot sales or on development charges.

Responding to widespread complaints about arbitrary queries, CBIC directed registration officers to seek only the documents listed in Form GST REG-01. For rented premises a valid rent agreement with the owner's ownership proof suffices; for owned premises any one ownership document is enough; no-objection certificates suffice for consent premises. Officers must not demand physical originals, question the applicant's residential address or business activity, or raise presumptive queries, and any query must be specific and approved by the Deputy or Assistant Commissioner.

Meeting by video conference barely a fortnight after rollout, the Council found that the combination of a twenty-eight per cent rate and the compensation cess rates originally fixed had left cigarettes bearing less tax than under the earlier excise and VAT regime, handing manufacturers a windfall. The Council recommended an increase in the compensation cess rates on cigarettes so as to align the total GST incidence with the pre-GST level, and the revised cess rates were notified with effect from 18 July 2017.
What to do about it: It showed early on that the Council would move within days to correct a rate that produced an unintended windfall, in either direction.
