The taxpayer had deposited about Rs. 29.83 crore into the electronic cash ledger before the due dates but filed GSTR-3B late for several tax periods between July 2017 and December 2019, and interest was demanded for the delay. The High Court dismissed the challenge, holding that a deposit in the electronic cash ledger is only money held to the taxpayer's credit and does not discharge tax liability. Liability is discharged only when the ledger is debited on filing the return, so interest runs until then.

Courts insist the power is draconian and must be exercised with genuine, recorded reasons, which is a strong ground of challenge in suitable cases.
I received a GSTR-3A notice for not filing my GST returns. What should I do?
GSTR-3A is a system-generated default notice issued under Section 46 when you fail to file a return such as GSTR-3B. Yes, but only within defined limits. Under Section 69, the Commissioner must record reasons to believe that a person has committed one of the serious specified offences, chiefly fake invoicing and evasion beyond the prosecution thresholds, before authorising arrest. For cognizable, non-bailable cases, the person must be produced before a Magistrate within twenty-four hours; for bailable offences, the Deputy or Assistant Commissioner can grant bail.
