A charitable trust ran a medical store attached to its hospital, selling medicines at a discount, and argued that as it worked without profit motive it was not carrying on business and needed no registration. The High Court held that the sale of medicines is a supply of goods, and that the absence of a profit motive does not take the activity outside the definition of business under the CGST Act. The trust was therefore required to obtain registration once the threshold was crossed.
Why this matters: Trusts, societies and associations in Chennai cannot assume that having no profit motive means no GST — registration turns on the supply, not the motive.

To back up the registration processing instruction, CBIC required every CGST Zone to publicise a dedicated email address for registration grievances on its website and on the notice board of the concerned office.
